After my father died, my husband Nolan told me the house I inherited was controlled by a trust administrator. I believed him until I found incomplete trust papers showing only pages fourteen and fifteen. I contacted my father’s attorney, Elaine Mercer, and learned the truth: I was the successor trustee and sole beneficiary. The house was fully paid off, and my father had left $186,420 for taxes and repairs. Yet Nolan had been charging me $900 a month in rent through a company he secretly created called Hearthstone Residential Management.

Elaine then showed me a deed of trust against the property. Nolan had used my father’s house to secure a $140,000 business loan and moved the money into Hearthstone accounts. The trust specifically prohibited anyone from using the property as collateral without my independent written consent. I had never given that consent. Elaine compared the signature on the deed with mine and found obvious differences. Nolan had forged my name.

The investigation uncovered an even larger scheme. For five years, Nolan collected my rent while the trust paid the property’s taxes, insurance, and repairs. He had also diverted nearly $60,000 from the trust reserve, disguising the transfers as maintenance expenses. When investigators reviewed messages and emails, they found evidence that Nolan knew the property belonged solely to me.

Elaine protected the remaining assets and challenged the fraudulent deed. The lender froze the disputed account, Hearthstone was dissolved, and Nolan faced charges for forgery and fraud. Most traceable funds were recovered, and the missing trust pages revealed additional protections my father had deliberately included.

I kept the house and rebuilt the trust records myself. When Nolan later asked me to remember our good years, I deleted his message. My father had left me more than property; he had left me protection, independence, and control over my own future.
