My Neighbor Poured Her Home’s Foundation Onto My Land While My Wife and I Traveled, Then the Surveyor Found Everything

My wife and I left town for a long weekend, expecting everything to be the same when we returned. Instead, our neighbor Priscilla had begun building an addition, and a massive concrete foundation extended onto our property. After checking our old survey, I discovered several missing boundary markers. I hired a licensed surveyor, who confirmed the encroachment, but Priscilla insisted the land belonged to her. Frustrated, I contacted my attorney, Martha Kline, and provided her with the deed, survey, and photographs. After reviewing the evidence, she told me, “Don’t touch that foundation yet. Let me see what we can do.”

The next morning, Martha secured an emergency court order authorizing me to remove the portion of the foundation built on my land, with the costs charged to Priscilla. I arrived the following day with a concrete saw, an excavator, and my fence crew. Priscilla rushed outside, shouting that I was trespassing and threatening to call the sheriff. When a deputy arrived, he carefully examined the court order and confirmed that the removal was legally authorized.

Everything changed when Priscilla’s concrete contractor arrived. Seeing the replacement survey markers, he admitted that he had warned her about the property line before construction began. He then revealed, “I told her the pins were in the way,” he said. “She paid my guys to pull them out.” The contractor explained that Priscilla had deliberately ordered the workers to remove the original markers because she believed she could finish the foundation before anyone stopped her. He provided work records and messages supporting his account, strengthening our case.

The court eventually ordered Priscilla to cover the costs of correcting the encroachment and other expenses permitted under the ruling. Her addition had to be redesigned to remain entirely on her property. After the concrete was removed, we rebuilt our fence along the surveyed boundary and documented every marker to prevent another dispute.

Months later, Priscilla apologized, admitting she had assumed nobody would challenge her once the concrete was poured. I accepted her apology, although our relationship never fully recovered. The experience taught me that property boundaries must be respected. What Priscilla thought would give her an advantage ultimately cost her far more than following the survey would have.
